Terms of Service
Last updated October 12, 2026
These terms are an agreement between you and RecordTide LLC ("we", "us"), which provides RecordTide (the "Service"). By subscribing to or using the Service you agree to them. If you subscribe on behalf of a company, you agree for that company.
1. The Service
RecordTide is a subscription list of newly opening businesses, compiled from public government records such as sales-tax permits and alcohol license applications. Each subscription ("edition") covers a vendor category and an area (one metro or all of Texas) and is delivered by email.
2. Orders and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Subscriptions renew automatically each month or year until cancelled. You can cancel at any time and keep access until the end of the paid period. Refunds are described in our Refund Policy.
3. Accuracy of data
Records come from public sources and are provided as is. Pending applications may be withdrawn, delayed or denied, and records may contain errors made by the issuing agency. We do not guarantee that any business will open or will buy from you.
4. Acceptable use
You may use the Service only for lawful business-to-business marketing and research. You agree that you will not:
- use the Service to decide eligibility for credit, insurance underwriting, employment or housing, or for any purpose covered by the Fair Credit Reporting Act;
- make autodialed, prerecorded or artificial-voice calls, or send marketing texts, to anyone without the consent the law requires;
- send email that violates the CAN-SPAM Act, or contact anyone who has asked not to be contacted;
- imply that you are affiliated with a government agency or that a business must buy from you;
- resell, republish or share the digest outside your company.
You are responsible for your own outreach and for following the TCPA, Do Not Call rules, CAN-SPAM and state law. Draft openers in the digest are suggestions you must review, not scripts. We may suspend or end your access if you break these rules.
5. Intellectual property
We own the digest format, selection and written content. Your subscription gives you a non-transferable license to use editions internally during your subscription.
6. Disclaimers and limits
The Service is provided "as is" without warranties of any kind, to the extent the law allows. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages, or lost profits.
7. Indemnity
You will defend and indemnify RecordTide LLC against claims arising from your outreach or your breach of these terms.
8. Changes
We may update these terms. We will email subscribers about material changes at least 14 days before they take effect.
9. Governing law
These terms are governed by the laws of Florida, United States.
